Acceptance of these Terms
By visiting our site, creating an account or placing an order, you agree to these Terms and to the policies referenced in them — our Shipping Policy, Refund Policy and Privacy Policy — which form part of this agreement. If you do not agree with them, please do not use the site or buy from us.
The version of these Terms published on this page at the moment you place an order is the version that applies to that order.
Who can buy from us
To place an order you must be at least 18 years old and legally able to enter into a binding contract. We sell and ship only within the United States, so your delivery address must be a valid U.S. address. We do not ship internationally, and we cannot accept orders that ask us to forward a package outside the United States.
You also agree not to use our products or our site for any unlawful purpose or in violation of any law that applies where you live.
Your account and your information
You can check out as a guest or create an account. If you create one, you are responsible for keeping your password confidential and for everything that happens under your account. Tell us right away at support@zwellnessco.com if you believe someone else has access to it.
You agree to give us accurate, current and complete information — especially your name, email address and shipping address. Orders are shipped to the address you enter at checkout, so mistakes there can delay or lose a delivery. We may suspend or close an account, or refuse service, if the information provided is false, incomplete or used to abuse our policies. How we handle your personal data is described in our Privacy Policy.
Products, colors and availability
We do our best to describe and photograph our products accurately, but we cannot guarantee that your screen displays colors exactly as they are in real life. Photos are illustrative, and packaging may change from batch to batch. Sizes, weights and measurements are approximate.
All products are offered subject to availability, and quantities may be limited. We may change, discontinue or stop offering any product at any time without notice. Product descriptions, specifications and content on this site may occasionally contain typographical errors or inaccuracies, and we reserve the right to correct them at any time, including after an order has been submitted.
Prices and pricing errors
All prices are shown in U.S. dollars (USD). Unless stated otherwise, prices do not include shipping charges or applicable sales tax, which are calculated and displayed at checkout before you pay.
Prices, promotions and discount codes may change at any time without notice. The price that applies to your order is the one shown at the moment you complete checkout. Promotional codes are subject to their own conditions, cannot be exchanged for cash and cannot be combined unless we say so.
Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If a product's correct price is higher than the price shown, we may cancel the order and refund you in full, or contact you first and give you the option to confirm the order at the correct price or cancel it — even if the order has already been confirmed and your payment method charged. We are not obligated to sell a product at an incorrect price.
Orders, and our right to refuse or cancel an order
When you submit an order, you are making an offer to buy. The confirmation email you receive acknowledges that we got your order; it is not our acceptance of it. The sale is only final when we ship the order.
We reserve the right to refuse, limit or cancel any order, in whole or in part, at any time. Reasons include, without limitation: the item is out of stock; a pricing or description error; payment that cannot be authorized or that appears fraudulent; orders that look like they are placed for resale rather than personal use; unusual quantities of the same item; an address we cannot ship to; or any order that appears to breach these Terms. We may also limit purchases per person, per household or per order.
If we cancel your order, we will email you at the address you provided and refund any amount already charged, in full, to your original payment method.
Need to cancel or change an order yourself? Email support@zwellnessco.com as soon as possible — within 24 hours of ordering is best. Once a package has been handed to the carrier, we can no longer cancel or modify it.
Payment
By submitting payment information you represent that you are authorized to use the payment method you provide and that the information you give us is true and complete. Payments are handled by third-party payment processors; we do not store your full card number on our systems.
You authorize us to charge your payment method for the total amount of your order, including shipping and any applicable taxes. If your payment is declined, reversed or cannot be settled, we may cancel the order.
If you see a charge you do not recognize, please email support@zwellnessco.com before filing a dispute with your bank — in most cases we can identify the order and resolve it faster than a chargeback can.
Shipping, delivery and transfer of risk
Delivery times, shipping rates, tracking and what happens when a package is late, lost or damaged are all described in our Shipping Policy. Delivery estimates are carrier estimates, not guarantees, and we are not responsible for delays caused by the carrier, severe weather or other events outside our control.
Title and risk of loss for the products pass to you once the carrier takes possession of your package. That said, we stand behind our deliveries: if a package is confirmed lost in transit or arrives damaged, the remedies described in our Shipping Policy apply, provided you contact us within the timeframes stated there.
Returns and refunds
Return windows, the condition items must be in, and how refunds are issued are set out in our Refund Policy, which is part of these Terms. Returns must be requested and authorized by email before anything is shipped back to us — packages returned without prior authorization cannot be processed. Shipping charges you have already paid are not refundable unless the return is the result of our error.
Intended use of our products and health disclaimer
Z Wellness sells general wellness and personal care products — items such as EMS neck and shoulder massagers, stretching devices, support pillows and cushions, insoles and compression socks. They are intended for everyday comfort, relaxation and general well-being.
Our products are not medical devices, and nothing we publish is medical advice. Statements on this site and in our marketing have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease or medical condition. Individual experiences vary, and we make no promise that any product will produce a particular result for you.
Always talk to a licensed healthcare professional before using any of our products if you are pregnant or nursing, if you are being treated for any medical condition, or if you are unsure whether a product is right for you. In particular, do not use electrical stimulation (EMS) products if you have a pacemaker, an implanted defibrillator or any other implanted electronic or metallic device, and never place them over the heart, the front or side of the neck, the head, broken or irritated skin, or areas with no sensation. Do not use compression socks, insoles or massage products over an injury, an open wound, a skin infection, a rash, a recent surgical site, or if you have circulatory problems, blood clots, diabetes, neuropathy or reduced sensation, without your doctor's approval.
Stop using a product immediately and seek medical attention if you feel pain, dizziness, skin irritation, numbness or any unusual discomfort. Always read and follow the instructions and warnings that come with the product, and keep all products away from children. You use our products at your own risk and are responsible for using them as intended.
Our intellectual property
All content on this site — text, product descriptions, photographs, graphics, logos, page layouts, video and the compilation of it all — is owned by Z Wellness or by its licensors and is protected by U.S. and international copyright, trademark and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable and revocable license to view and use the site for your own shopping purposes. You may not copy, reproduce, republish, distribute, sell, frame, scrape, data-mine or create derivative works from any part of the site or its content for commercial purposes without our prior written permission. “Z Wellness” and our logo are our trademarks; any other names or marks that appear on the site belong to their respective owners.
Reviews and content you submit
You may be invited to submit product reviews, photos, comments, questions or other content. We want honest feedback, so a few rules apply.
- Reviews must be real. Only submit a review if you actually purchased or used the product, and describe your genuine experience. Fake, purchased, incentivized-for-a-positive-rating, duplicated or competitor-planted reviews are prohibited.
- We do not pay for positive reviews. We never condition a gift, discount or other benefit on a review being favorable, and if any incentive is ever offered for a review, it will be disclosed and will apply regardless of what the review says.
- We do not delete reviews for being critical. We may remove content that is unlawful, obscene, abusive, off-topic, spam, fraudulent, that impersonates someone, that infringes another party's rights, that contains personal or medical information about another person, or that makes claims our products cannot support — but a negative review is not removed simply because it is negative.
- Keep health claims out of it. Please do not state or imply that a product diagnoses, treats, cures or prevents a disease. We may edit or decline to publish content that does.
You are solely responsible for the content you submit and confirm that it is your own and does not violate anyone else's rights. By submitting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual and irrevocable license to use, reproduce, adapt, publish, translate and display it on our site and in our marketing, with the name you submitted it under. We are under no obligation to monitor, publish or keep any submission, and submissions are not confidential and create no obligation to pay you.
Prohibited uses
In addition to everything else in these Terms, you may not use our site or its content:
- for any unlawful purpose, or to encourage anyone else to break the law;
- to violate any regulation, rule, ordinance or law that applies to you;
- to infringe our intellectual property rights or those of anyone else;
- to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone;
- to submit false or misleading information, or to impersonate another person;
- to upload or transmit viruses, malware or any code that could affect how the site or a related system works;
- to collect or track the personal information of others, to scrape, spider, crawl or harvest the site, or to send spam, phishing or other unsolicited messages;
- to interfere with, disable, overload or circumvent the security features of the site;
- to purchase products for commercial resale without our prior written consent.
We may terminate your access to the site and cancel your orders for violating any of the above.
Disclaimer of warranties and limitation of liability
We do not guarantee that your use of our site will be uninterrupted, timely, secure or error-free, or that the results obtained from using it will be accurate or reliable. From time to time we may suspend or withdraw the site, in whole or in part, without notice.
To the fullest extent permitted by law, the site and the products are provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Some states do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you, and nothing here affects any warranty rights you have under applicable law.
To the fullest extent permitted by law, Z Wellness and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages — including lost profits, lost data, loss of use, or personal injury arising from misuse of a product or from ignoring its instructions and warnings — arising out of your use of the site or of any product bought through it.
Where liability cannot be excluded, our total liability for any claim will not exceed the amount you actually paid for the product that gave rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by our negligence.
Indemnification
You agree to indemnify, defend and hold harmless Z Wellness, its owners, employees, agents, suppliers and service providers from any claim, demand, loss, liability or expense — including reasonable attorneys' fees — made by any third party and arising out of your breach of these Terms or of the documents they incorporate, your violation of any law or of the rights of a third party, or your misuse of any product purchased from us.
Changes to these Terms
We may update these Terms at any time by posting the revised version on this page. Changes take effect as soon as they are published, and the date of the most recent update is shown by our store on this page. It is your responsibility to check this page from time to time; continuing to use the site or placing a new order after a change means you accept the updated Terms. Changes do not apply retroactively to orders already placed.
Governing law and general provisions
These Terms, and any separate agreement by which we provide you products, are governed by and construed in accordance with the laws of the United States of America and of the state in which Z Wellness is established, without regard to its conflict of law rules. You agree that any dispute arising out of these Terms or your purchase will be brought exclusively in the courts located in that jurisdiction, and you consent to their jurisdiction.
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the fullest extent permitted and severed from the rest, and the remaining provisions stay in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the policies published on our site, are the entire agreement between you and us regarding your use of the site and your purchases, and they replace any earlier version.
